Kevin Lunny, owner of Drakes Bay Oyster Co. along Point Reyes National Seashore, said Tuesday that he filed the suit claiming the Department of the Interior, Salazar and others failed to comply with national environmental law and violated his constitutional rights.
Interior spokesman Blake Androff said Salazar's decision came after careful consideration of applicable law and policy.
Lunny intends to ask a judge to issue an injunction blocking the eviction while the lawsuit makes its way through the courts.
The oyster farm was given 90 days to cease operations after its lease expired Nov. 30.
