Josephine County cannabis ordinance overruled
The Oregon Court of Appeals has overturned commercial cannabis restrictions in Josephine County.
This is a major setback for the county's effort to crack down on commercial cannabis.
The restrictions included zoning and size limits for growing plots - but that alone wasn't the issue.
The Oregon Court of Appeals ruled that when Josephine County imposed restrictions last year they did so without following the proper legal process.
The lawsuit was brought against the county by local growers. It is considered a victory for them, but does not stop future restrictions from being imposed.
Josephine County Commissioner Lily Morgan tells News 10 that the board of commissioners will meet next Tuesday at 2pm to discuss how they plan to move forward.
